The ‘Data Controller’ De Rigo Refrigeration S.r.l. pursuant to Art. 24 of EU Regulation 2016/679 (hereinafter also referred to as the ‘EU Regulation’), isthe controller of personal data and in implementation of Art. 13 of the EU Regulation provides the following information.

Personal data collected

Personal data relating to participants in events with video/audio/photos collected for dissemination and/or promotional purposes.The data will be processed in both paper and digital form. These generic images concern events that can be qualified as public eventsand, therefore, are processed without the need for explicit consent, for possible publication on our websites/landing pages and social profiles (e.g. Twitter, Facebook, Instagram, Youtube, etc.) and on brochures, catalogues, flyers and other printed and/orcomputerised material relating to the promotion of events, also in compliance with the provisions of art. 97 of l. 633/1941 and Art.10 of the Civ. Code.

Purpose and legal basis of processing

The data will be processedfor the following purposes:

1. collection of images of individuals in the context of promotional and/or training events by means of photos/videofootage for publication (dissemination) for dissemination and promotional purposes. The legal basis of the legitimate interest consists in the difficulty of the practical management that a collection of consent could entail in identifying theinterested parties who issue a denial in the release, the minimisation of the processing adopted (e.g. prevailing use of panoramic images that do not allow the unambiguous identification of the interested party, respect for the decorum ofthe subjects filmed, deletion of any images of so-called ‘weak’ subjects – minors, disabled persons, ) as well asthe organisational/information measures adopted to allow the interested party to protect his or her rights. (Legitimateinterest of the holder (Art. 6 (1) (F).

Recipients of personal data

Within the scope of the stated purposes, data may be processed:

1. by authorised personnel of our Company and by professionals (photographers and communication agencies) of ourtrust who, in their capacity asformally appointed data processors pursuant to Art. 28 of the EU REGULATION;

Data transfer to third countries

The management and storage of personal data takes place on servers located within the European Union of the DataController and/or third party companies appointed and duly appointed as Data Processors. The servers are currentlylocated in Italy. Data may be transferred outside the European Union limited to the above-mentioned purposes through the publication of the images on social platforms and/or the institutional website www.derigorefrigeration.com.

Data retention period

Personal data will be kept for the period of time strictly necessary for the pursuit of the specific processing purposes indicated and in any case until you decide to submit a request to object to the processing. The data subject is informed that selected imagesmay be retained indefinitely for historical archiving purposes by the holder.

Rights of the Data Subject

The person concerned may, at any time, exercise the rights set out below.

1. Access topersonal data: to obtain confirmation of whether or not personaldata concerning him or her are being processed and, if so, access to the following information: the purposes, thecategoriesof data, the recipients, the storage period, therightto lodge acomplaint with asupervisory authority, the right to requestrectificationor erasure or restrictionof processing or toobject to processing, and the existence of an automated decision-making process;
2. Request for rectification or erasure of data or restriction of processing concerning him/her; ‘restriction’ means themarking of retained data with the aim of limiting the ir processing in the future;
3. Objection to processing: to object on grounds relating to the particular situation to the processing of data for theperformance of a task in the public interest or in pursuit of a legitimate interest of the Controller;
4. Data portability: in thecase of automated processing carried outon thebasis of consent or inperformance of a contract,to receive the data concerning you in a structured, commonly used and machine-readable format; in particular, thedata will beprovided to youby the Data Controllers in .xml, or similar, format;
5. Withdrawal of consent to processing for marketing purposes, bothdirect and indirect, marketresearch andprofiling; the exercise of this right shall in no way affect the lawfulnessof processingcarried outprior to thewithdrawal;
6. File a complaint pursuant to 77 GDPR to the competent supervisory authoritybased on the data subject’shabitual residence, place ofworkor place of infringement of their rights.

Likewise, in the event of a breach of the law, the user has the right to lodge a complaint with the Personal Data Protection Authority, as the authority responsible for monitoring processing in the Italian State.
